The following terms and conditions (the “Terms”) apply to our provision and your use of the information, services and materials (“Online Content and Courses”) through Deanna Ford’s Speaking School website (the “School”) including you visiting and browsing the School website (being a “Visitor”) and registering with Deanna Ford’s Speaking School (as a “student”).

Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Deanna Ford’s Speaking School. If you do not agree to these terms, do not use this Site.

These Terms should be read alongside, and are in addition to our privacy policy.

You need an account for most activities on our platform, including to purchase and enroll in a course. When setting up and maintaining your account, you must provide and continue to provide accurate and complete information, including a valid email address. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission. This means you need to be careful with your password. You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. In the event of the death of a user, the account of that user will be closed.

The only exception to the above paragraph is this: students must be at least 18 years of age to create an account on Deanna Ford’s Speaking School and use the Services. If you are younger than 18 but above the required age for consent to use online services where you live (for example, 13 in the US or 16 in Ireland), you may not set up an account, but we encourage you to invite a parent or guardian to open an account and help you enroll in courses that are appropriate for you. If you are below this age of consent to use online services, you may not create a Deanna Ford’s Speaking School account. If we discover that you have created an account that violates these rules, we will terminate your account.

Deanna Ford’s Speaking School may offer users the ability to post messages on message and discussion boards and other interactive areas as a part of the School Services (collectively, “Forums”), which may be open to the public generally, to all members of the Company Sites, or to a select group of members to a specific Forum group. You acknowledge that all Content posted on Forums is User Content, and by posting on Forums you agree to comply with the rules and restrictions on User Content set forth above and any other rules specifically applicable to such Forums. Deanna Ford’s Speaking School reserves the right, but disclaims any obligation or responsibility, to prevent you from posting User Content to any Forum and to restrict or remove your User Content from a Forum or refuse to include your User Content in a Forum for any reason at any time, in Deanna Ford’s Speaking School sole discretion and without notice to you.

You acknowledge that messages posted on Forums are public, and Deanna Ford’s Speaking School cannot guarantee the security of any information you disclose through any forum; you make such disclosures at your own risk. Deanna Ford’s Speaking School is not responsible for the content or accuracy of any information posted on a Forum, and shall not be responsible for any decisions made based on such information.

2.2 Use of Discussion Forums

Students come to the School to have a safe and engaging learning experience and all are invited to post comments and questions. But you also agree not to spam or troll the forum, nor post content that is unethical, racist, bigoted or is commercial content designed to drive traffic to a third party site or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead other students as to the source of material (such as spoofing).

2.3 Testimonials Disclaimer for Deanna Ford’s Speaking School

Deanna Ford’s Speaking School may contain testimonials by users of our products and/or services. These testimonials reflect the real-life experiences and opinions of such users. However, the experiences are personal to those particular users, and may not necessarily be representative of all users of our products and/or services. We do not claim, and you should not assume, that all users will have the same experiences. Your individual results may vary.

The testimonials on the Site are submitted in various forms such as text, audio and/or video, and are reviewed by us before being posted. They appear on the Site verbatim as given by the users, except for the correction of grammar or typing errors. Some testimonials may have been shortened for the sake of brevity where the full testimonial contained extraneous information not relevant to the general public.

The views and opinions contained in the testimonials belong solely to the individual user and do not reflect our views and opinions. Users are not paid or otherwise compensated for their testimonials.

2.4 Access to Courses

Each course in the School has its own length of access time. 

For "How to Sound Professional Teaching Online" , you have guaranteed access to this course for a minimum of 180 days (6 months) from your date of purchase. 

For "5x10 Video Creation Workshop" (Pilot), you have guaranteed access to this workshop materials for 30 days. Access time may be extended.

3. Trademark and Copyright

Deanna Ford’s Speaking School, The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws.

‍In legal, more complete terms, the School grants you (as a student) a limited, non-exclusive, non-transferable license to access and view the course and associated content for which you have paid all required fees solely for your personal, non-commercial, educational purposes through the Services, in accordance with these Terms and any conditions or restrictions associated with the course. Deanna Ford’s Speaking School authorizes each Student to view and download one copy of the Materials that are released for download for their sole use. All other uses are expressly prohibited. You may not reproduce, modify, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, describe, summarize, transfer or otherwise reveal the Materials or their contents, to any other person or entity unless we give you explicit permission to do so in a written agreement signed by the School. This also applies to content you can access via any of our APIs. Any breach of these Terms of Use automatically terminates your authorized use of the Site.

4. Payments and Refunds 

Payments: You agree to pay the fee for course that you purchase, and you authorize us to charge your credit card (through Stripe) or process other means of payment (PayPal) for those fees. The School works with third party payment processing partners to offer you the most convenient payment methods in your country and to keep your payment information secure.

When you make a purchase, you agree to use a valid payment method. If you use an invalid or unauthorized payment method or for some other reason your payment method fails and you still get access to the course you are enrolling in, you agree to pay us the corresponding fees within 15 days of notification from us. If we have not heard from you for 5 days acknowledging our notification, you may be denied access to the course. Furthermore, we reserve the right to disable access to any course for which we have not received payment.

Refunds:

Refunds are by course or workshop. 

"How to Sound Professional Teaching Online" 

Deanna Ford’s Speaking School wants you to be satisfied, so if you are not feeling that way with the course, please make your first course of action to be to contact the instructor, Deanna Ford to discuss the matter. 

If a resolution cannot be found, and you desire it, the tuition amount will be refunded if the request falls within 30 days of purchase. An administration fee of $10 will be applied to all requests after 48 hours of purchase.

Refusal of refund request: We reserve the right, in our sole discretion, to limit or deny refund requests in cases where we believe there is refund abuse, including but not limited to the following:

At the School’s discretion, if we believe you are abusing our refund policy, we reserve the right to deny your refund, ban your account, and/or restrict all future use of the Services. Students who have their account banned or course access disabled due to a violation of our Terms will not be eligible to receive a refund. These refund restrictions will be enforced to the extent permitted by applicable law.

No refund is due to you if you request it after the 30-day guarantee time limit has passed.

"5x10 Video Creation Workshop" (Pilot)

As this is a hands-on workshop, refunds will only be granted after the first or second live training sessions. The window for requesting a refund closes with the third live training session. With that session, no other refunds will be granted.

Deanna Ford’s Speaking School has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. ‍The information provided by Deanna Ford’s Speaking School on the Site is for general informational purposes only. All information on the Site is provided in good faith, however we make no representation or warranty of any kind, express or implied regarding accuracy, adequacy, validity, reliability, availability, or completeness of any information on the Site.

7. Limitation of Liability

In no event will Deanna Ford’s Speaking School, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever arising out of the use, inability to use, or the results of the use of this Site, any websites linked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

Unless otherwise indicated, the Site is our proprietary property and all audio, video, text and graphics on the site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by Deanna Ford’s Speaking School or licensed to us and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of Canada, foreign jurisdictions, and international conventions.

It may happen that our platform is down, either for planned maintenance or because something goes down with the site. It may also happen that we encounter security issues. These are just examples. You accept that you will not have any recourse against us in any of these types of cases where things don’t work out right. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right.
